California state law requires businesses to participate in programs to minimize organic waste going to the landfill. In December 2021, the City Council of the City of Barstow adopted Chapter 6.39 of the Municipal Code as required by Senate Bill 1383, which is intended to accomplish the following goals:
- Improve air quality by reducing greenhouse gas emissions from organic waste disposal such as food and landscape/green waste
- Conserve natural resources, preserve limited landfill space, and strengthen the economy
- Recover edible food and redistribute to address food insecurity
The law requires all businesses (and multifamily properties) to implement the following:
- Recycle their organic waste including food waste and landscape waste
- Recycle the recyclable materials such as plastics, cardboard, paper, metal, glass, and other items
Businesses can comply with the regulations by subscribing to the proper recycling services with Burrtec and separating its recyclables, food waste, and landscape waste from general trash.

If your business does not currently have a blue recycling container, a brown food waste container, and a green landscape waste container in addition to a black/gray trash container, please contact 760.255.5162 to establish the proper services and achieve compliance.
If your business does not generate food waste and/or landscape waste, lacks physical space to add the applicable container(s), or if your business hauls its own organics to a permitted processing facility, it may qualify for a waiver.

SB 1383 and Edible Food Recovery
Under the regulations, the city is now required to have an Edible Food Recovery Program, ensuring that edible food generators have written agreements with local recovery organizations describing the types of food being collected for distribution, the frequency that food will be collected, and keeping record of the quantity of food recovered per month so it can be reported to the State.
Your business is required to participate if it falls under Tier 1 or Tier 2 descriptions below:
